Authorization for Dyno Tuning Services & Release of Liability and Waiver Form

1. As the Customer, I hereby represent that I have read and completed the required procedures and checks and that I, being of a minimum 18 years of age have full authority to authorize the testing/tuning of this vehicle and to enter into this Waiver/Release.
2. As the Customer, I agree to the standard rate of $150/hour for Dyno service performed by Engineered Motorsport Solutions Inc.
3. As the Customer, I am aware that all tests are intended to be and will be at maximum performance and at wide-open throttle, thus applying stress similar to that which the vehicle would experience during operation on the road/track and is therefore susceptible to the same or greater risks as on the road/track which may cause engine, power train and/or tire/wheel failure or damage.
4. Testing and tuning on the Dyno will push your vehicle to its mechanical limits. It is your responsibility to ensure that your car is in good working order and capable of handling the stresses incurred when your car’s limits are reached. Engineered Motorsport Solutions Inc. and its employees, directors and officers are in no way responsible for ANY damage to your vehicle incurred before, during or after your vehicle is operated on the Dyno.
5. As there are many components that may fail on a car at any time outside of Engineered Motorsport Solutions Inc’s control, Engineered Motorsport Solutions Inc. does not guarantee nor warranty or guarantee either expressed or implied any Engineered Motorsport Solutions Inc. product or service. In the event that Engineered Motorsport Solutions Inc. has performed any service to my vehicle prior to running on the Dynamometer, I acknowledge that all results and conditions of the vehicle have been discussed openly and honestly where I agree that the vehicle is in an acceptable condition to run on the Dynamometer.
6. In the event that Engineered Motorsport Solutions Inc has never performed a service to my vehicle, I hereby represent that I know the condition of the vehicle and I assure that it is in acceptable condition to run on the Dynamometer. I have been advised that Engineered Motorsport Solutions Inc. does not know, nor assumes any such knowledge of the condition of the vehicle being tested/tuned and I nevertheless, agree to have my vehicle run on the Dynamometer. As the “Customer” I represent that all parts of the vehicle are in good condition and are capable of full power and full throttle performance during any testing/tuning being performed.
7. I hereby authorize and release the dynamometer tests and/or service work to be done along with the necessary materials, parts and labor and hereby grant Engineered Motorsport Solutions Inc. and its employee’s permission to operate the vehicle or combustion engine for the purpose of testing and tuning.

Engineered Motorsport Solutions Inc, its owners, and staff reserves the right to decline or discontinue dynamometer services for any reason at any time. By signing this waiver, I hereby acknowledge that I am aware of the potential risks involved with Dyno testing / tuning and that I hereby acknowledge and voluntary release and forever discharge, Engineered Motorsport Solutions Inc., its employees, directors and officers from ANY and EVERY claim, demand, action or right of action including but not limited to either in law or equity, arising from or by reason of vehicle damage, any bodily or personal injury, death or property damage, known or unknown, resulting to or resulting from the owners/operators of dynamometer test equipment.
